Drug Company Sued for Failure to Warn Doctors

 SAN DIEGO, Cali. – A personal injury lawsuit has been filed by a Virginia man against Amylin Pharmaceuticals, the manufacturer of the injectable diabetes drug  Byretta(R) as well as the drug’s co-marketer Eli Lilly and Company.  The suit, filed in the San Diego Superior Court, may be the first of its kind against the manufacturer of a pharmaceutical company.

The suit claims that the drug company failed to adequatley warn doctors of the associated risk of pancreatitis, of measure needed to properly assess the appropriateness of prescribing the drug to certain categories of patients, and of measures doctors and patients could and should take to minimize the risk.

Florida families sue state for witholding birth injury assistance

 TAMPA, Flor. – In the state of Florida, children who sustain severe brain or spinal cord injuries during birth are eligible for lifetime benefits.  However a new class action lawsuit claims that a pair of Tampa Bay parents and other have not received the full compensation they are owed for tending to the needs of their disabled children.

A county judge has certified the class action suit, but has yet to rule on the merits of the claim.  Yet in his order, the judge cited evidence of the Florida Birth-Related Neurological Injury Compensation Association refusal to pay some parent in full.

The association is responsible for distributing funds for a wide range of needs deemed medically necessary and reasonable.

Murder Victim’s Son Awarded $650,000

Ohio – In an effort to restore some peace to their children and immediate families, the George family has agreed to pay the son of the slain Jeff Zack $650,000.  The civil suit was brought on after Cynthia George’s conviction for soliciting a third party to murder Zack was overturned.

George had been found guilty of soliciting her current lover John Zaffino to kill her former lover Zack in 2001.  Her sentence was overturned after a 9th circuit appeals court ruled that, although Zaffino was guilty of Zack’s murder, the case lacked sufficient evidence to prove that George solicited him to commit the murder.

Zack’s 19-year-old son is a university student.  He will be awarded $428,000 from the settlement, with the rest going towards attorney’s fees.
