WI Family Wins Medical Malpractice Suit

A decision from a unanimous jury handed down Friday afternoon found in favor of Chad and Amy Jelinek of Prairie du Chien, Wisconsin. In their medical malpractice suit against Gunderson Lutheran Medical Center staff, the Jelineks claimed that negligent treatment caused their son Laine’s brain damage. Laine was delivered in the medical center by midwife Glenda Pinkham and registered nurse Michelle Dwyer in August 2005. According to the suit, Pinkham and Dwyer failed to adequately monitor Laine’s health during the birth, or to call in a doctor when the birth became difficult. As a result Laine developed cerebral palsy and now requires constant care.

The Jelineks will now be compensated for medical expenses, Laine’s reduced earning potential and suffering, and Amy and Chad’s loss of companionship. The total amount of their award amounts to $11.4 million.

Sports Bar Wants Out of Dram Shop Suit

 A sports bar facing a dram shop suit seeking $200,000 in damages is filing to have the charges against it dropped.

The male plaintiff  filed suit against the drinking establishment alleging that he sustained injuries in an auto accident while he was a passenger driven by the co-defendant in the suit, who had been drinking at the bar prior to the accident.  The plaintiff, who was also drinking at the bar, claims he was of the legal drinking age, but that the female defendant was not yet 21-years-old at the time of the accident.

He claims the co-defendant became intoxicated from the beverages she was served while at the bar named in the suit.  The suit alleges that the plaintiff fell asleep and passed out at the bar sometime throughout the night.  Bartenders had to carry and assist him to the co-defendant’s car, but failed to restrain him with a seat belt.

Once on the freeway, the co-defendant lost control of her vehicle causing it to overturn several times.

Japanese Billionaire Sued for Negligence

HONOLULU, Hawaii – A Honolulu attorney has filed a personal injury suit against Japanese billionaire Genshiro Kawamoto on behalf of a Ma’ili woman who claims she was injured by debris from a Kawamoto property.

According to the attorney the plaintiff injured her back, knee, and elbow after tripping and falling over pieces of a broken wall and palm fronds on the sidewalk area in front of a Kawamoto home.  The damages being sought were not specified in the suit.

The suit also alleges that the plaintiff suffered severe and permanent physical injuries, emotional distress as a result of the billionaire’s negligence.  They will be seeking lost wages, both past and present, as a part of the damages.
