ThedaCare seeks dismissal for wrongful death case

ThedaCare, a Wisconsin healthcare organization, has recently asked for a dismissal in Winnebago County Court. ThedaCare is being sued by Delores Wiersum’s family for staff negligence. Wiersum died in Appleton while under the care of ThedaCare’s Heritage Assisted Living.

In July, the Wiersums’ claimed that Heritage Assisted Living’s negligence caused Delores Wiersum mental anguish, emotional distress, and death. The Wiersum family asked for an unspecified amount of money for punitive damages, medical costs, and funeral expenses.

ThedaCare’s lawyers said that the plaintiffs shouldn’t able to collect compensation because they didn’t adhere to the Wisconsin state law requiring medical malpractice cases to be checked by an independent mediation panel before court filing.

A motion hearing for the case is set for January 14.
