Florida families sue state for witholding birth injury assistance

by Administrator 15. September 2008 06:09
TAMPA, Flor. - In the state of Florida, children who sustain severe brain or spinal cord injuries during birth are eligible for lifetime benefits.  However a new class action lawsuit claims that a pair of Tampa Bay parents and other have not received the full compensation they are owed for tending to the needs of their disabled children. A county judge has certified the class action suit, but has yet to rule on the merits of the claim.  Yet in his order, the judge cited evidence of the Florida Birth-Related Neurological Injury Compensation Association refusal to pay some parent in full. The association is responsible for distributing funds for a wide range of needs deemed medically necessary and reasonable. If your child has suffered a birth injury and you believe it is due to the doctor's or hospital's negligence, you may be entitled to recover damages for your losses.  Contact the Racine birth injury lawyers of Habush, Habush, & Rottier, S.C. at 800.682.3434 for a free initial consultation.  We will discuss your case and further legal options.

20,000 Turks Die Annually from Medical Malpractice

by Administrator 27. June 2008 03:06
Every year, about 20,000 people in Turkey die because of medical malpractice.    Comparatively, only about 6,000 to 10,000 people die in the country each year due to automobile accidents.  Additionally, experts estimate that if incorrect prescriptions and pharmacy errors are added into this statistic, it could skyrocket as high as 50,000 deaths a year.  The Anatolian Health Center claims the medical system is designed in a way that leads medical staff to make mistakes frequently. If you or a loved one has suffered because of medical malpractice, contact the experienced Racine medical malpractice personal injury lawyers of Habush Habush & Rottier today at 800.682.3434 to discuss your specific situation.

Bill to Allow U.S. Troops to Sue for Medical Malpractice

by Administrator 4. June 2008 04:06
If approved, the Carmelo Rodriguez Military Medical Accountability Act, proposed by New York congressman Maurice Hinchey, would reverse a 1950 U.S. Supreme Court decision that protects the military from medical malpractice lawsuits.  The bill would allow claims for damages for death or personal injury cases resulting from negligence, failure to act, or wrongful acts in medical and dental practices.  The lawsuits would be brought against the military, as an institution, rather than the individuals performing or not performing the acts. The bill is named for Carmelo Rodriguez, who died at the age of 29 because military doctors misdiagnosed malignant melanoma as a birthmark.  Supporters of this bill claim it will protect officers from lawsuits from lower ranking military members while also holding doctors accountable for their level of medical care. If you have suffered due to medical malpractice, it is important to consult with an attorney.  The Racine personal injury lawyers of Habush Habush & Rottier can help you today at 800.862.3434.
