If approved, the Carmelo Rodriguez Military Medical Accountability Act, proposed by New York congressman Maurice Hinchey, would reverse a 1950 U.S. Supreme Court decision that protects the military from medical malpractice lawsuits.  The bill would allow claims for damages for death or personal injury cases resulting from negligence, failure to act, or wrongful acts in medical and dental practices.  The lawsuits would be brought against the military, as an institution, rather than the individuals performing or not performing the acts. The bill is named for Carmelo Rodriguez, who died at the age of 29 because military doctors misdiagnosed malignant melanoma as a birthmark.  Supporters of this bill claim it will protect officers from lawsuits from lower ranking military members while also holding doctors accountable for their level of medical care.
